Terms of service

These terms are a contract between you and funmemo ("funmemo", "we") for the use of https://www.fun-memo.com and the videos we make for you. By creating an account or buying a pack you agree to them. If you do not agree, please do not use the service.

1. What funmemo does

You upload photos; we use AI models to generate short animated clips from them and assemble those clips, with music, captions and an opening card, into a video you can download and share. Results are generated by machine learning and vary from photo to photo. We do not promise any specific look, and we offer free retries and a money-back guarantee instead (sections 6 and 7).

2. Your account

• You must be at least 18 years old.
• Sign-in is by one-time email link. Keep your email account secure; anything done from your account is your responsibility.
• One free-trial animation per person. Creating multiple accounts to get more free animations is not allowed and may lead to account closure.

3. Your content and permissions

• You keep all rights to the photos, music and text you upload and to the videos we make from them.
• You confirm that you own the photos or have permission from whoever does, and that the people in them (or their parents or guardians, for minors) would not object to being animated in a private gift video.
• You grant us a limited license to store, process and transmit your content only as needed to provide the service, including sending photos to our AI model providers. We do not use your content to train AI models and we do not use it in marketing without your written consent.
• Music you upload is your responsibility. Our built-in library is licensed for use inside your funmemo video.

4. What you may not upload

• Sexual content, or any content that sexualizes minors.
• Photos of people used to harass, deceive, impersonate or defame them.
• Content you do not have the right to use, or that breaks any law.

We use automated safety checks and may refuse, remove or report content that violates these rules, and close accounts that upload it.

5. Animations, packs and credits

• A pack is a one-time purchase of a number of "animations" (roughly 5-second clips). Animations are credits on your account and do not expire.
• One animation credit is used each time a new clip is generated from a photo pair (or from one photo in Classic style). Retries within the free retry allowance (3 per animation) do not use credits.
• Re-rendering the final video with different music, captions or format does not use credits.
• Credits are personal to your account and cannot be transferred, except by buying a gift card.
• Prices are in US dollars. Sales tax is added at checkout where required. Prices may change; the price at the time of purchase applies.

6. Retries and results

AI video generation sometimes produces clips that look wrong. Each animation includes three free retries, with or without your instructions, and you can swap the photo. Some photos cannot be animated well (faces hidden, very small, or heavily damaged), and some may be declined by our model providers' safety systems; in those cases the credit is returned to your balance.

7. Refunds

Every pack is covered by a 30-day money-back guarantee described in our Refund policy. Add-ons that have already been delivered (for example a narration that was generated) are refunded only as part of a full pack refund.

8. Gift cards

Gift cards are delivered by email, redeem for animation credits, and do not expire. They are not redeemable for cash except where required by law. We may cancel gift cards bought with fraudulent payment.

9. Delivery and storage

Videos are delivered in your studio as a download and as a private, unlisted gift link. Source photos are deleted 30 days after your last edit and finished videos are kept as described in the Privacy policy. Download your video to keep it.

10. Our service

We will do our best to keep funmemo available and fast, but we do not guarantee uninterrupted service. We may change or discontinue features. If we discontinue the service entirely we will give at least 30 days' notice and refund unused credits bought in the previous 12 months.

11. Disclaimer and limitation of liability

The service is provided "as is". To the fullest extent permitted by law, we disclaim all warranties, and our total liability to you for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.

12. Indemnity

You will cover us for claims by third parties arising from content you upload in breach of section 3 or 4.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Before going to court, you agree to contact us and try to resolve the issue informally for 30 days. Consumers keep any rights they have under the mandatory laws of where they live.

14. Changes to these terms

We may update these terms. We will change the date above and, for material changes, email account holders. Continuing to use funmemo after that means you accept the new terms.
